Important Notice: I-9 Compliance & Audit Support
With immigration enforcement increasing, businesses across industries—including hospitality, manufacturing, and construction—are experiencing heightened scrutiny from Immigration and Customs Enforcement (ICE) and the Department of Homeland Security (DHS). Recent updates to federal policy have increased fines for I-9 paperwork violations to as much as $2,789 per worker, and fines for knowingly employing an undocumented worker start at $5,579 per violation.
To ensure your organization is prepared:
Respond promptly if a Simploy payroll representative contacts you regarding an I-9 update or correction. Compliance is a shared responsibility, and timely action helps protect your business.
Regularly review your I-9s to correct any errors and ensure forms are completed properly for all active employees. Businesses should retain I-9s for at least three years from the start date or one year after termination, whichever is later.
Understand your rights if government agents visit your business. While ICE may conduct audits, they cannot access non-public areas without a signed warrant. If you receive a Notice of Inspection, you typically have three business days to provide requested documents.
